Welcome to ClimaCall. These Terms and Conditions (“Terms”) govern your use of the ClimaCall platform, website, mobile applications, and related services (collectively, the “Service”) provided by ClimaCall Inc. (“ClimaCall,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
To use the Service, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

The Service is offered on a subscription basis. Current pricing and plan details are available on our pricing page. We reserve the right to modify pricing with 30 days’ notice.
By subscribing to the Service, you authorize us to charge your payment method on a recurring basis. All payments are processed securely through Stripe.
We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
Subscription fees are generally non-refundable. However, we may provide refunds at our discretion on a case-by-case basis.

You retain ownership of all content you submit to the Service (“User Content”). By submitting User Content, you grant ClimaCall a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely to provide the Service.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it.
The Service, including all content, features, and functionality, is owned by ClimaCall and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
The Service may integrate with third-party services (e.g., payment processors, mapping services). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIMACALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless ClimaCall and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may cancel your subscription at any time through your account settings.
Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive.
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Collin County, Texas.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance.
